1. Acceptance of Terms and Service Operation

By accessing the website or using this artificial intelligence resume generation platform (hereinafter the "Service"), you agree to comply with these Terms of Use.

The Service is technically developed, maintained, and operated by 12 services-conseils inc. Even when the Service is offered under the visual identity, domain name, or brand of a commercial partner or organization (white-label or multi-tenant model), these terms govern the use of all software and algorithmic features.

2. Service Description and 4-Step User Journey

The Service allows candidates to restructure, optimize, and translate their resumes according to Canadian hiring standards. The user experience centers around an automated 4-step process:

• Profile & Import: Entry of basic contact details, selection of target occupation (NOC code), choice of language (French or English), and upload of an existing resume (PDF format, maximum 5 MB).
• AI Analysis: Automated processing by artificial intelligence for data extraction and content optimization.
• Review & Customization: Preview of the generated resume, text content editing for each section (Profile, Achievements, Professional Experience, Education and Professional Development, Additional Information), and application of AI recommendations.
• Download & End of Session: Export of the final document in PDF format, instant translation options, and management of data deletion preferences.

3. White-Label Model, License, and Intellectual Property

• Distribution Model: The platform is a SaaS (Software as a Service) software solution, distributed under corporate licenses (B2B) or directly accessible to candidates (B2C).
• Property Rights: All intellectual property rights related to the platform, source code, algorithms, software architectures, layout templates, and artificial intelligence prompt logic remain the exclusive and inalienable property of 12 services-conseils inc.
• Candidate Content Ownership: Candidates retain full ownership of their personal information and professional experience data submitted to the platform.

4. AI-Generated Content, Standard Format, and Liability

• Canadian Standard (2-Page Target): To comply with Canadian hiring standards favouring concise resumes, the AI is configured to prioritize extracting and formatting your four (4) most recent professional experiences and four (4) most recent qualifications. Users can add content manually during the review step, but we no longer guarantee a 2-page format if extensive content is added.
• AI Disclaimer: Artificial intelligence is an IT assistance tool that may generate inaccuracies, omit details, or misinterpret elements from the source document.
• Mandatory User Verification: It is the exclusive and mandatory responsibility of the user to review, verify, and correct all information generated by the AI before exporting, printing, or transmitting their resume to an employer or recruiter.
• Limitation of Liability: 12 services-conseils inc. and its white-label partners disclaim all liability regarding candidate rejection, factual inaccuracies, or any direct or indirect damage resulting from the use of the generated resume.

5. Rules of Conduct and Strict Exclusions

Users agree to use the Service strictly for the purpose of creating a compliant professional resume. It is strictly prohibited to:

• Add Photographs or Visuals: In compliance with Canadian anti-discrimination rules, no profile photo or avatar may be uploaded or inserted.
• Enter Sensitive Data: Mentioning sex, gender, date of birth, marital status, Social Insurance Number (SIN), or any other non-job-related information is prohibited.
• Provide False Statements: Users warrant that all information entered is truthful, accurate, and free from misrepresentation.
• Impersonate or Upload Illegal Content: Any upload of defamatory, obscene, virus-laden, or third-party-infringing content is strictly prohibited.

6. Financial Terms and Payments

• Individual Candidates (B2C): Applicable service fees for downloads or access to paid features are clearly displayed prior to the transaction. Online payments are securely processed through our PCI DSS-certified subcontractors (Stripe). No sensitive banking data is stored on our servers.
• Free Access Limitations and Purchase Obligation: To ensure the quality of algorithmic processing, free access to artificial intelligence analysis is limited per user. The first two (2) logins made with the same email address grant access to the free automated CV analysis. Starting from the third (3rd) login with this same email address, the platform will suspend the free analysis. The user will be required to subscribe to a paid plan to unlock the AI processing of their document and continue using the Service.
• Organizational Licenses (B2B): Payments for multi-tenant corporate licenses are completed via institutional bank transfer or secure banking transaction.
• Accounting Retention: In accordance with Canadian tax requirements (CRA and Revenu Québec), payment receipts, invoices, and proofs of transaction are retained for six (6) years.

7. Hosting in Canada, 7-Day Rule, and Automated Purge

• Canadian Sovereignty: All data and files are hosted on secure servers located exclusively in Canada.
• Immediate Deletion Option: At step 4, users can check the "Delete my data immediately upon leaving the platform" box to instantly destroy all files and session data.
• 7-Day Persistence and Automatic Purge: Unless immediate deletion is selected, the latest document and profile details are retained for seven (7) calendar days to allow candidates to return and edit their resume. Upon expiration of this period, data is automatically and permanently deleted without possibility of recovery.

8. Service Modifications and Governing Law

• Modifications: We reserve the right to modify, suspend, or discontinue any aspect of the Service, and to revise these Terms of Use at any time.
• Governing Law: These Terms of Use are governed by and construed in accordance with the laws applicable in the Province of Quebec and the federal laws of Canada applicable therein.
